1. Assumption of Risk
I understand and acknowledge that golf simulator use and golf activity involve inherent risks. These include, without limitation, being struck by golf clubs, struck by golf balls, ricochet or rebound impact, slips, trips, falls, physical exertion, and potential equipment malfunction. I voluntarily accept and assume all risks associated with entering or using the facility and participating in any related activity.
2. Release and Waiver of Claims
On behalf of myself and my heirs, representatives, executors, administrators, and assigns, I release, waive, and discharge The Turn Golf Lounge LLC, its owners, officers, employees, agents, contractors, and affiliates from any and all claims, liabilities, demands, or causes of action arising from or related to injury, illness, death, or property damage that may occur in connection with use of the facility, whether arising from ordinary negligence or otherwise, to the fullest extent permitted by law.
3. Indemnification
I agree to defend, indemnify, and hold harmless The Turn Golf Lounge LLC and its owners, officers, employees, agents, contractors, and affiliates from and against any losses, damages, costs, liabilities, or expenses (including reasonable attorneys' fees) arising out of or connected to my conduct, my use of the facility, or my violation of facility rules or applicable law.
4. Responsibility for Guests and Minors
Members and sponsoring guests accept responsibility for the conduct of all guests they bring into the facility. A parent or legal guardian accepting this waiver on behalf of a minor confirms authority to do so and agrees to all waiver terms on the minor's behalf.
5. Acknowledgment of Understanding
I confirm that I have read and understood this waiver, that I understand I am giving up substantial legal rights (including the right to sue in many circumstances), and that I agree to these terms voluntarily and without coercion. My entry into or continued use of the facility constitutes acceptance of this waiver.
6. Governing Law
This waiver is governed by the laws of the State of Ohio, without regard to conflict of laws principles.
Participant Confirmation
By participating in activities at The Turn Golf Lounge LLC, I acknowledge that I have read this Waiver of Liability, understand its contents, and voluntarily agree to its terms.
